On February 21, 2025, Congressmen Brett Guthrie (R-KY-2) and John Joyce (R-PA-13), Chairman and Vice Chairman of the House Committee on Energy and Commerce, respectively, issued a Request for Information (“RFI”) asking stakeholders to provide comments to the newly formed data privacy working group. Chairman Guthrie and Vice Chairman Joyce established the working group earlier this month “to bring members and stakeholders together to explore a framework for legislation that can get across the finish line” and said that the “need for comprehensive data privacy is greater than ever.” The working group includes 8 other members of the House Energy & Commerce Committee.
The RFI requests information from stakeholders on a range of topics, including how federal comprehensive privacy legislation should define “personal information” and “sensitive personal information,” how such a law should interact with existing state and federal privacy laws, and how such a law should account for state-level artificial intelligence frameworks. The RFI also asked about controller and processor responsibilities, data security, and enforcement mechanisms.
